1. Eligibility

If you are under the age of 18, you represent that you have permission from a parent or legal guardian to use the Service.

You may only use Flyer Hero in compliance with applicable laws and regulations.

2. Account Registration

Certain features require creating an account.

You agree to:

• Maintain current account information
• Accept responsibility for activities conducted through your account

You are responsible for safeguarding your account and notifying us immediately of any unauthorized use.

3. User Content

“User Content” includes any information, images, photographs, logos, graphics, text, event details, or other materials you upload or submit through Flyer Hero.

You retain ownership of your User Content.

By submitting User Content, you grant Flyer Hero a limited, non-exclusive license to:

• Store the content
• Process the content
• Modify the content as necessary to provide the Service
• Generate flyer designs based on the content

This license exists solely for operating and improving the Service.

4. Content Rights and Permissions

You represent and warrant that:

• You own or have permission to use all uploaded content.
• Your content does not infringe copyrights, trademarks, privacy rights, or other legal rights.
• You have obtained consent from individuals appearing in uploaded images when required by law.

Flyer Hero is not responsible for verifying ownership or permissions related to uploaded content.

5. AI-Generated Designs

Flyer Hero uses artificial intelligence technologies to generate flyer designs and related content.

You acknowledge that:

• AI-generated results may contain inaccuracies or unexpected outputs.
• Similar or identical outputs may be generated for different users.
• Flyer Hero does not guarantee uniqueness of generated designs.
• You are responsible for reviewing generated content before publishing or distributing it.

Flyer Hero makes no warranties regarding the suitability, legality, accuracy, or originality of AI-generated content.

6. Acceptable Use

You agree not to use Flyer Hero to create, upload, or distribute content that:

• Violates any law or regulation
• Infringes intellectual property rights
• Contains defamatory, abusive, or harassing material
• Promotes violence or criminal activity
• Contains malware, viruses, or harmful code
• Exploits or harms minors
• Is fraudulent, deceptive, or misleading
• Contains sexually explicit material
• Promotes hate speech or discrimination

We reserve the right to remove content or suspend accounts that violate these Terms.

7. Subscription Plans and Payments

Some features may require payment.

By purchasing a subscription or credits, you agree that:

• Fees are charged in advance.
• Prices may change with reasonable notice.
• Payments are processed through Stripe or other authorized payment providers.
• You are responsible for applicable taxes.

Failure to pay may result in suspension or termination of access to paid features.

8. Refund Policy

Unless required by law, payments are non-refundable.

Because Flyer Hero provides immediate access to digital services and AI-generated content, refunds are generally not available after credits have been used or designs have been generated.

We may issue refunds at our sole discretion in exceptional circumstances.

9. Intellectual Property

Flyer Hero, its branding, logos, software, design systems, and underlying technology are owned by Flyer Hero and protected by applicable intellectual property laws.

These Terms do not grant you ownership of Flyer Hero intellectual property.

You may not:

• Copy or redistribute our software
• Reverse engineer the platform
• Attempt to access source code
• Use Flyer Hero branding without permission

10. Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted availability.

We may:

• Modify features
• Add or remove functionality
• Suspend maintenance periods
• Discontinue portions of the Service

without prior notice.

11. Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the platform
• Create legal or security risks

You may stop using the Service at any time.

Termination does not relieve you of outstanding payment obligations.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYER HERO DISCLAIMS ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY
• RELIABILITY
• AVAILABILITY

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYER HERO SHALL NOT BE LIABLE FOR:

• INDIRECT DAMAGES
• INCIDENTAL DAMAGES
• SPECIAL DAMAGES
• CONSEQUENTIAL DAMAGES
• LOST PROFITS
• LOST DATA
• BUSINESS INTERRUPTION

ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO FLYER HERO DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless Flyer Hero, its owners, affiliates, employees, and service providers from claims, damages, liabilities, and expenses arising from:

• Your use of the Service
• Your uploaded content
• Your violation of these Terms
• Your infringement of any third-party rights

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict-of-law principles.

Any disputes arising from these Terms shall be resolved in the state or federal courts located in Texas.

16. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be posted on FlyerHero.net with a revised Effective Date.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
